Important Legal Notice — Please Read Carefully

My Learning Ladder™ (MLL) is an original proprietary educational architecture developed and solely owned by ThinkBeanz®. The intellectual property contained within the My Learning Ladder™ ecosystem — including all associated educational, technological, research, assessment, and learning architectures — constitutes proprietary intellectual property protected under applicable national and international copyright, trademark, trade secret, database rights, unfair competition, contract, and related laws and conventions.

All Rights Reserved. No part of this intellectual property may be used, accessed, reproduced, adapted, distributed, or otherwise exploited without the prior express written authorisation of ThinkBeanz®.

1. Ownership of Intellectual Property

Unless expressly stated otherwise in a signed written agreement, ThinkBeanz® is the sole and exclusive owner, controller, licensee, or duly authorised rights holder of all intellectual property contained within the My Learning Ladder™ (MLL) ecosystem.

The intellectual property rights referred to herein extend to all associated frameworks, models, methodologies, learning architectures, assessment architectures, inquiry systems, growth systems, cognitive systems, prompt orchestration systems, educational philosophies, training methodologies, research methodologies, teaching methodologies, evaluation methodologies, learning pathways, competency frameworks, visual frameworks, rubrics, assessment tools, software systems, databases, websites, publications, digital assets, audio, video, graphic and visual materials, course materials, training resources, proprietary terminology, brand identities, logos, design systems, user interfaces, documentation, research outputs, and all future versions, enhancements, adaptations, extensions, and derivative developments thereof.

2. Strictly Prohibited Activities

Without the prior express written authorisation of ThinkBeanz®, the following activities are expressly and unconditionally prohibited:

• Copying, reproducing, duplicating, scanning, recording, storing, distributing, transmitting, publishing, displaying, sharing, reposting, translating, digitising, or otherwise disseminating any My Learning Ladder™ content, in whole or in part, in any medium or format, whether now known or hereafter developed.
• Creating, developing, or authorising derivative works based upon, derived from, or substantially similar to any My Learning Ladder™ intellectual property.
• Replicating, reverse-engineering, restructuring, adapting, modifying, rebranding, renaming, reformatting, or otherwise recreating the MLL framework, model, methodology, architecture, assessment system, inquiry system, growth model, or educational process.
• Using any My Learning Ladder™ intellectual property as the basis for commercial products, educational products, software platforms, learning management systems, training programmes, certification programmes, consulting offerings, coaching services, assessment systems, artificial intelligence tools, or competing products or services.
• Incorporating any MLL content, framework, methodology, architecture, terminology, prompts, assessments, models, visual representations, structures, concepts, or processes into educational institutions, training organisations, businesses, software products, or commercial services.
• Teaching, licensing, sublicensing, certifying, franchising, commercialising, monetising, reselling, or otherwise redistributing any My Learning Ladder™ intellectual property.
• Creating adaptations or substantially similar works designed or intended to circumvent copyright, trademark, contractual, or intellectual property protections.
• Utilising any proprietary framework structure, framework sequence, implementation methodology, scoring methodology, learning pathway, assessment mechanism, terminology architecture, prompt architecture, visual architecture, growth architecture, or inquiry architecture to create competing products or services.
• Claiming ownership, authorship, inventorship, co-authorship, modification rights, adaptation rights, or derivative rights with respect to any My Learning Ladder™ or ThinkBeanz® intellectual property.

3. Artificial Intelligence, Machine Learning, and Data Training Restrictions

No content, framework, model, methodology, assessment system, prompt system, educational architecture, visual representation, publication, database, software component, documentation, or other intellectual property belonging to My Learning Ladder™ or ThinkBeanz® may be used for any of the following purposes, whether directly or indirectly, and whether in whole or in part:

• Scraped, harvested, extracted, mined, indexed, crawled, or collected by automated systems, bots, spiders, or similar technologies.
• Used for training, fine-tuning, benchmarking, evaluating, validating, testing, or otherwise improving artificial intelligence, machine learning, or large language model systems.
• Included within any machine learning dataset, training corpus, or evaluation benchmark.
• Replicated, generated, or synthesised through generative artificial intelligence systems.
• Incorporated into AI-generated educational, assessment, or inquiry products or services.
• Used to generate or inform derivative educational frameworks, assessment tools, or methodological content.
• Utilised for synthetic content generation, knowledge distillation, or model knowledge extraction.

Any such use constitutes wilful infringement of ThinkBeanz®’s intellectual property rights and shall be subject to all available legal remedies, including injunctive relief and claims for damages.

4. Framework Protection Notice

My Learning Ladder™ (MLL) is an original proprietary educational architecture independently developed and protected as the intellectual property of ThinkBeanz®.

Intellectual property protection extends not only to the written content of the framework but also, without limitation, to the following elements:

• Conceptual structures and framework logic
• Methodological sequences and cognitive processes
• Assessment mechanisms and inquiry pathways
• Growth pathways and competency progressions
• Terminology systems and lexical architecture
• Visual representations and framework organisation
• Operational methodologies and prompt structures
• Implementation processes and training methodologies
• Certification methodologies and digital implementations

Unauthorised replication of the underlying framework architecture — including where such replication involves modification, renaming, translation, restructuring, simplification, expansion, or partial reproduction — may constitute infringement and misappropriation of ThinkBeanz®’s intellectual property rights.

5. Trademark and Brand Protection

ThinkBeanz®, My Learning Ladder™, MLL, and all associated logos, taglines, product names, service names, domain identities, programme names, visual identities, and branding elements are protected trademarks, service marks, trade dress, and/or registered intellectual property rights of ThinkBeanz®.

Any use of these marks or any substantially similar designation that is likely to cause confusion, imply association, endorsement, affiliation, or sponsorship, or that results in dilution, misrepresentation, or unfair competitive advantage is strictly prohibited and may give rise to trademark infringement proceedings.

6. No Implied Licence

Access to My Learning Ladder™ websites, publications, platforms, educational resources, software systems, assessments, training programmes, or documentation does not, in any circumstance, grant any ownership rights, licence rights, commercialisation rights, adaptation rights, implementation rights, teaching rights, certification rights, reproduction rights, or derivative development rights.

No rights, licences, or permissions shall be implied, inferred, or otherwise derived from publication, access, purchase, enrolment, participation, download, possession, or use of any My Learning Ladder™ material.

Rights are granted solely and exclusively through a duly executed written agreement signed by an authorised representative of ThinkBeanz®.

7. Enforcement and Remedies

ThinkBeanz® actively monitors and vigorously enforces its intellectual property rights on a worldwide basis.

Unauthorised use of My Learning Ladder™ intellectual property may, without limitation, result in one or more of the following:

• Immediate cease-and-desist demands
• Civil proceedings for copyright and/or trademark infringement
• Domain name dispute proceedings
• Contractual enforcement actions and claims for breach of agreement
• Applications for emergency and permanent injunctive relief
• Claims for actual, statutory, or exemplary monetary damages
• Recovery of lost profits and unjust enrichment
• Recovery of legal costs and attorney’s fees
• Platform takedown requests and Digital Millennium Copyright Act (DMCA) notices
• Account suspension or termination requests to hosting providers and technology platforms
• Civil and criminal prosecution where permitted by applicable law

ThinkBeanz® expressly reserves all rights and remedies available under applicable national and international law. The commencement of enforcement action in one jurisdiction shall not preclude concurrent or subsequent action in any other jurisdiction.

8. Licensing and Permissions

Any proposed educational, academic, institutional, research, software, artificial intelligence, commercial, consulting, training, certification, publication, translation, adaptation, implementation, or distribution use of My Learning Ladder™ intellectual property requires the prior express written permission of ThinkBeanz®.

No permission, licence, or authorisation shall be implied by publication, access, purchase, enrolment, participation, download, or possession of any My Learning Ladder™ material. Prospective licensees should direct all licensing enquiries to an authorised representative of ThinkBeanz®.
